1. In the instant writ petition filed under Article 226 of the Constitution of India, petitioner has assailed his order of punishment dated 22.12.2025 whereby he dismissed from his service, whereagainst counsel for petitioner admits during course of arguments that petitioner has already preferred a Departmental Appeal and same is pending consideration.
2. In view of pendency of the Departmental Appeal against the punishment order, filing of this writ petition is misplaced and unwarranted at this stage, therefore, counsel for petitioner seeks permission to withdraw this writ petition with liberty to pursue the Departmental Appeal against the impugned order of punishment.
3. Accordingly, the writ petition stands disposed of with liberty as prayed for.
4. Stay application and other pending application(s), if any, stand disposed of.
