JUSTICE M.I.ARUN ORAL ORDER 1. The petitioners have made a complaint to respondent Nos.1 to 3 stating that respondent No.4 has put up construction in violation of the building bye-laws and the sanctioned plan. 2. Learned counsel appearing for respondent no.4 denies the same. 3. However, learned counsel appearing for the Greater Bengaluru Authority (respondent Nos.1 to 3) upon instructions submits that subsequent to filing of the writ petition, a survey has been conducted in respect of the construction put up by respondent No.4 and it is found that respondent no.4 has put up construction in violation of the building bye-laws and the sanctioned plan. It is further submitted that the GBA shall initiate suitable action against respondent no.4 in the manner of law. Hence, the following:- - 4 - HC-KAR NC: 2026:KHC:21055 WP No. 2505 of 2026 ORDER i. The writ petition is disposed of. ii. Respondent Nos.1 to 3 (GBA) are hereby directed to initiate appropriate action against respondent No.4 for putting up construction in violation of the building bye-laws and the sanctioned plan. iii. Respondent No.4 is at liberty to defend his action in the manner known to law. iv. If there is any dispute between the petitioners and respondent no.4 in respect of the encroachment of their respective properties, they are at liberty to approach the Civil Court in the manner known to law. v. Till a decision is taken by respondent Nos.1 to 3 in respect of the illegal construction put up by respondent No.4, respondent No.4 will not put up any additional construction.
