However, Mr. J.F.Toppo, G.A.-V is present for the State. Since this is an old case of 2015; this Court is proceeding to decide it on the basis of documents available on records. 2. The instant writ application has been preferred by the petitioner praying for a direction upon the respondent authorities to revise the appropriate salary with effect from 01.01.1986 in the pay scale of Rs. 975-1540 in place of 800-1150 in view of the Finance Department Resolution dated 18.12.1989 and further revise in pay scale of Rs. 3050-4590 in place of 2610-3540 in view of Finance Department Resolution dated 8.2.1999 and to revise 2026:JHHC:3325 2 appropriate salary in view of the Finance Department Resolution dated 28.2.2006 in pay scale of Rs. 5200-20200 in Grade pay Rs. 1900/- further to pay differences of pay scale revised in aforesaid Resolution to the petitioner and further to calculate and pay the retiral benefits in appropriate revised scale and accordingly to pay the differences amount in leave encashment, Gratuity and permanent pension and to pay other consequential benefits which is payable to the petitioner and to pay statutory and panel interest on aforesaid amount to the petitioner. 3. A counter affidavit dated 29.03.2016 has been filed in this case wherein the respondents have taken the following stands: “8. That at the very outset is stated and submitted that the petitioner for grant of a particular pay scale which was payable in the year 1986 has approached this Hon'ble Court in the year 2015 i.e. after lapse of about 3 decades and on this ground alone the writ petition is liable to be dismissed for delay and latches. 9. That it is stated and submitted that the resolution no. 6022 dated 18.12.1989, on the basis of which the petitioner is claiming the benefits is related with the payment of the teachers of Government School and the resolution does not explain anything about library drafts. 10. That it is stated and submitted that as per the recommendation of the 5th pay Revision Committee issued vide resolution no. 660 dated 08.02.1999, the existing pay scale of the petitioner i.e. Rs. 800-1150/- has been revised in pay scale of Rs. 2610-3540/-. 11. That it is stated and submitted that the said pay fixation was done in accordance with resolution of Finance Department being resolution no. 660 dated 08.02.1999, the pay scale of Sorter in head of Government Library is Rs. 2610-3540/- which has been given to the petitioner 12. That it is stated and submitted that as per the recommendation of 6th Pay Revision Committee, the pay scale of petitioner was fixed Rs. 5200-20200/- and has been granted grade pay of Rs. 1800/-. The petitioner is claiming Grade Pay of Rs.1900 which is nowhere in Government Library hand. 13. That it is stated and submitted that in view of the facts stated above, it is evident that the pay scale of petitioner in the light of recommendation of 4th, 5th and 6th Pay Revision Committee has rightly been 2026:JHHC:3325 3 fixed and therefore the petitioner is not entitled for any relief as claimed in the present writ petition.” 4. Counter affidavit was filed in the year 2016 and there is no rebuttal by way of any rejoinder. Moreover, the petitioner is also not interested in pursuing this case; inasmuch as, for the last several dates he has not been serious, either he is taking adjournment or he is not appearing in this case. Even otherwise, the claim of the petitioner is with regard to pay scale which was payable in the year 1986; meaning thereby to say, the cause of action arose in the year 1986 and the instant application has been filed in the year 2015, which clearly goes to show that the petitioner slept over the matter for three decades and suddenly woke up and filed the writ application and also did not deny the specific averments made in the counter affidavit referred to hereinabove. 5. Having regard to the aforesaid facts and circumstances, the instant writ application stands dismissed. Pending I.A(s), if any, also stands closed.
