The petitioner is apprehending his arrest in connection with Sarawan P.S. Case No. 27/2021, registered for the offence under Sections 147/148/ 149/341/342/332/427/225/353/387 of the Indian Penal Code, pending in the Court of learned Judicial Magistrate, 1st Class, Deoghar. 3. Learned counsel appearing for the petitioner submits that allegation against the petitioner is that he being a member of unlawful assembly, armed with deadly weapon and in prosecution of common object of the assembly used criminal force against the police personnel on duty and forcibly took the arrested co-accused-Sonu Rai from the custody of the police and after police apprehended him on getting information the petitioner along with co-accused persons were putting the passerby on the road in fear of death and was committing extortion. He also submits that petitioner has got no criminal antecedent, as disclosed in paragraph 10 of this application. He further submits that there is general and omnibus allegation against the petitioner and co-accused persons have been granted anticipatory bail in A.B.A. No.4196 of 2021, A.B.A. No. 6107 of 2021, A.B.A. No. 4539 of 2021 and A.B.A. ( 2026:JHHC:1421 ) -2- A.B.A. No. 250 of 2026 No.6258 of 2025. On these grounds, he submits that the petitioner may kindly be provided privilege of anticipatory bail. 4. Learned counsel appearing for the State opposed the prayer and submits that allegations are there of making assembly and altercating with the police personnel. 5. Considering that there is general and omnibus allegation against the petitioner and co-accused persons have been granted anticipatory bail in the aforesaid A.B.As. and he has got no criminal antecedent as disclosed in paragraph 10 of this application and in the attending facts and circumstances of the case, I am inclined to grant anticipatory bail to the petitioner. 6. Accordingly, the above named, petitioner is directed to surrender before the learned Court within three weeks from today and in the event of his surrender / arrest, he shall be released on bail, on furnishing bail bond of Rs. 25,000/- (Twenty-Five Thousand) with two sureties of the like amount each, to the satisfaction of learned Judicial Magistrate, 1st Class, Deoghar in connection with Sarawan P.S.
