The writ application has been preferred praying for direction for compensation as per RFCTLARR Act, 2013 within a time-bound period, or to consider and dispose of the petitioner’s objections, after giving the petitioner an opportunity of hearing. 3. Learned counsel for the State has brought the notice of this Court to the document at page 37 to the writ application, which is a letter addressed to the petitioner herein dated 11.02.2026 wherein it has been stated as follows : 2 “Sub: Complain regarding unauthorized construction and acquisition of private land. Ref:- Your letter dated 02-02-2026 With reference to the above noted subject, the undersigned would like to inform that the Department has taken an initiative to construct Cross drainage works for the interest of Public in 1.90km of Jalpaiguri- Choulhati Road. Therefore you are requested to submit proper land documents in relation with diversion of ongoing cross drainage works Thanking you, Yours Faithfully Assistant Engineer Jalpaiguri Highway Sub-Division Jalpaiguri 4. On hearing the learned counsels for the parties and on considering the issue involved, the writ application is disposed of with the direction that the respondent no. 6 shall conduct a hearing as per the said notice dated 11.02.2026 in presence of the petitioner and all other stake holders, if any. The respondent no. 6 shall also take the assistance of the local BL & LRO, being the respondent no. 7 herein with liberty granted to the petitioner to produce all the documents as called for and dispose of the hearing, within 60 days from the date of this order by passing a reasoned order, in accordance with law. 5. Writ application stands disposed of. 6. Connected application, if any, stands disposed of. 3 7.
