According to petitioner, a large chunk of land was vested in State vide order dated 01.08.2019 passed by Additional Collector (Finance & Revenue), Haridwar, however, that land is now being illegally transferred by certain unscrupulous persons to other private individuals. In this regard, petitioner has made a representation to District Magistrate, Haridwar on 26.12.2024. 4. Learned State Counsel, however, submits that this appears to be a private dispute between petitioner and the persons against whom complaint is made. He submits that petitioner is trying to settle his personal score by filing this writ petition. He submits that petitioner has not disclosed anywhere, whether he has encroached upon any Government land or water-body land. 5. Having regard to the facts and UKHC010210702025 2026:UHC:6041 circumstances of the case, the writ petition is disposed of with a direction to District Magistrate, Haridwar to hold an enquiry, within two months to ascertain whether petitioner has encroached upon any of public land, water body land etc. If it is found that petitioner is not an encroacher, then the District Magistrate shall proceed to consider petitioner’s representation dated 26.12.2024 and decide the same, as per law after hearing persons likely to be affected, within three months thereafter. However, if petitioner is found having encroached upon any public land, then the encroachment made by him shall be removed, even by demolishing the structure, if any, made by petitioner on public land.
