Since no adverse order is passed against the private respondent, notice to the private respondent is dispensed with. 2. This petition has been filed for a direction, directing the 1st and 2nd respondents to realign the canal presently running through the petitioners property comprised in Survey no 447 / 2B1B2C, Kundam Village, Tirupur District by shifting the same from inside the petitioners property to the boundary of the petitioners property through the cement pipeline already laid by the petitioner in terms of the proceedings of the 4th respondent dated 19.01.2026 thereby enabling the petitioner to have maximum beneficial use and enjoyment of the said property. 3. It is the case of the petitioner that the petitioner was earlier Ayacatdars of the canal forming part of the Parambikulam Aliyar Project irrigation system passes through the schedule property comprised in S.No.447/2B1B2C. Subsequently, on the basis of the petitioner's request, the course of the canal within the petitioner's property was slightly modified by laying a cement pipeline, thereby marginally shifting the alignment within the petitioner's own land up to the boundary of the petitioner's property. While so, the 5th respondent filed a complaint before the 4th respondent alleging the petitioner had disturbed https://www.mhc.tn.gov.in/judis WP No. 10934 of 2026 the canal. The fourth respondent after its inspection vide proceedings dated 19.01.2026 has recorded that the said pipeline arrangement does not in any manner affect the supply of irrigation water to ayacut lands and thereafter, the second respondent has issued notice in this regard. Hence, it is the grievance of the petitioner that canal can be effectively conveyed through the cement pipeline already laid within the petitioner's property and the canal presently running through the petitioner's property be realigned and shifted to the boundary of the petitioner's property through the said pipeline, thereby, the petitioner's can have maximum benefits and enjoyment of the property. Hence, this petition. 4. The learned senior counsel for the petitioner submitted that this Court may issue a direction to the second respondent to conclude the proceedings dated 05.02.2026 after providing opportunities concerned including the tail end farmers. 5. Heard the learned senior counsel for the petitioner and the learned Government Advocate and perused the materials placed on record. 6.Considering the facts and circumstances of the case, this Court without going into the merits of the case directs the second respondent to conclude the proceedings dated 05.02.2026 after giving notice and opportunity of hearing to https://www.mhc.tn.gov.in/judis WP No. 10934 of 2026 the petitioner as well as the tail end farmers within a period of 12 weeks from the date of receipt of a copy of this Order. 7.
