Ajay Mohan Goel, Judge (Oral) By way of this writ petition, the petitioner has inter alia prayed for the following relief:- “(i) The respondent University may kindly be directed to include the Secretariat Pay as part of the basic pay of the petitioner for calculation of all types of permissible allowances and pensionary benefits and to re-fix the pension of the petitioner in the interest of law and justice. (ii) Directions may kindly be issued to the respondents that after fixation of the pay of the petitioner by including the component of Secretariat Pay, the arrears accrued on the pension with effect from the date of retirement may kindly be ordered to be paid to the petitioner along with interest and further after such fixation, the arrears with respect to leave 1 Whether reporters of the local papers may be allowed to see the judgment? 2 2026:HHC:19357 encashment, commutation of Pension and gratuity etc. may also kindly be ordered to be paid to the petitioner along with all consequential benefits and interest thereof.” 2. Though reply to the petition has not been filed, but learned Counsel for the petitioner submits that the prayer made in the petition is covered by the judgment passed by Hon’ble Coordinate Bench of this Court in CWP No. 208 of 2020, titled as Sh. Durga Ram vs. Himachal Pradesh University and another and other connected matters, decided on 18.10.2022. Accordingly, he submitted that this petition be disposed of with the observation that the directions passed therein shall mutatis mutandi be treated to have been passed in this petition also. 3. Accordingly, this petition is disposed of by observing that the directions passed in abovementioned case, i.e., CWP No.208 of 2020, titled as Sh. Durga Ram vs. Himachal Pradesh University and another and other connected matters, decided on 18.10.2022, shall mutatis mutandi apply in the present case and shall be deemed to have been passed in this case also.
