This is the second bail application. The first bail application was dismissed as withdrawn vide order dated 29.08.2025 in M.Cr.C. No. 6329/2025. 2. This bail application is filed by the applicant under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 for grant of regular bail, as he has been arrested in connection with Crime No. 115/2024 registered at Police Station – Balrampur, District – Balrampur - Ramanujganj, Chhattisgarh for the offences punishable under Sections 64 (2), 65 (2) of the Bhartiya Nyaya Sanhita, 2023 and under Sections 4 & 6 of the Protection of Children from Sexual Offences (POCSO) Act, 2012. 2 3. Larned counsel for the applicant submits that this second bail applicaitn is filed after examination of the material witnesss and also on the ground that the applicnat is in jail since about 12.07.2024. 4. On the other hand, learned State counsel opposes the submission of counsel for the applicant and would submit that the vicitm (PW – 3) had supported the case of prosecution. She also contended that from the deposition of victim recorded before the Trial Court, it appers that the victim is deaf and dumb child. 5. I have heard learned counsel for the respective parties and perused the documents filed along with the bail application. 6. Taking into consideration, facts and circumstances of the case, nature of allegations, submission of learned counsel for the respective parties, documents enclosed along with the bail application in particular, deposition of victim, I am not inclined to admit this second bail application. 7. Accordingly, the bail application filed under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 is dismissed at the admission stage. Certified copy as per rules.
