The instant appeal, preferred under Section 21(4) of the National Investigation Agency Act, is directed against the order dated 14.10.2025, passed in Misc. Cr. Application No. 1889 of 2025 (Panki P.S. Case No. 157 of 2017, Special N.I.A. Case No. 08 of 2018, R.C. No. 23 of 2018/NIA/DLI/2018), by learned Addl. Judicial Commissioner-XVI-cum-Special Judge, NIA, Ranchi, registered for the offence under Section 120B read with Sections 386 & 411 of IPC, Sections 25(1-B) a, 26 & 35 of Arms Act, Section 17 & 18 of C.L.A. Act and Sections 10, 11, 17, 18, 20 & 21 of U.A.P. Act, whereby and whereunder, the prayer for regular bail of the appellant has been rejected. 2. Heard Mr. A.K. Sahani, learned counsel appearing for the appellant, at length. 3. Comprehensive counter affidavit has also been filed. 4. The matter was heard on 5th December, 2025 and in addition with a direction to file counter affidavit, status of the trial was also called for. 2026:JHHC:2645-DB 5. The status of trial is available on record. It has been reported that out of 131 prosecution witnesses, 54 witnesses have been examined. 6. Mr. A.K. Das, learned counsel appearing for the respondent-NIA, on instruction, has submitted that number of witnesses have been reduced by pruning to 60, out of which two witnesses have filed attendance today before the Trial Court. 56 witnesses have already been examined. The attendance of two witnesses has been filed in the Court today, out of which, one witness has already been discharged. It is therefore, submitted that now only further two witnesses are to be examined. 7. In view of the aforesaid, Mr. A.K. Sahani, learned counsel appearing for the appellant, on instruction, seeks leave of this Court to withdraw this criminal appeal so as to ensure expeditious disposal of the trial.
