The instant bail application has been filed under Section 483 BNSS on behalf of accused-applicant against the order dated 10.02.2026 passed by learned Sessions Judge, Jhalawar, District Jhalawar in connection with FIR No. 71/2026 registered at Police Station Kotwali Jhalawar District Jhalawar for the offences under Sections 308(2), 351(2), 221, 61(2), 111(2)(b) & 111(4) of BNS, by which the bail application of the accused-applicant under Section 483 of BNSS has been dismissed.

Learned counsel for the accused-applicant submits that the accused-applicant has falsely been implicated in this case. He further submits that the accused-applicant has not been named in the FIR, however, other accused persons have been specifically named in the FIR. Learned counsel further submits that in this matter, an amount of Rs. 11,57,980/- has been recovered as the
[2026:RJ-JP:22785] (2 of 3) [CRLMB-2887/2026] proceeds of crime at the instance of co-accused persons namely: Narendra Singh, Manoj Kumar, Babu Lal, Mohan Singh, Manish and Mahaveer and recovery has not been made from the possession qua the present accused-applicant. Learned counsel further submits that charge sheet has been filed and the accused- applicant was arrested on 02.02.2026, and since then he is behind the bars. Trial will take considerable time to conclude. It is also submitted that no other criminal case has been registered against the accused-applicant, therefore, the accused-applicant may be enlarged on bail.
3. Learned Public Prosecutor vehemently opposes the bail application.
4. Heard and perused the material available on record.

Considering the facts that the charge sheet against the accused-applicant alongwith other sixteen accused persons have already been filed for the offences under Sections 308(2), 351(2), 221, 61(2) of BNS; that the accused-applicant has not been specifically named in the FIR and no recovery has been made from his possession, whereas recovery of amount of Rs.11,57,980/- has been made from the possession of the other co-accused persons; that the accused-applicant is behind the bars since his arrest dated 02.02.2026; that the trial of the case may take considerable time and there are no criminal antecedents against the accused- applicant, therefore, without expressing any opinion upon merits/demerits of the case, this Court deems it fit to enlarge the accused-applicant on bail.
6. Accordingly, the present bail application filed under Section 483 BNSS is allowed and it is ordered that the accused-applicant
[2026:RJ-JP:22785] (3 of 3) [CRLMB-2887/2026] Ankit Gurjar S/o Radheyshyam, in connection with FIR No. 71/2026 registered at Police Station Kotwali Jhalawar, District Jhalawar, shall be enlarged on bail provided he furnishes a personal bond in the sum of Rs.1,00,000/- with two attested sureties of Rs.50,000/- each to the satisfaction of the learned trial Court. Accused-applicant is further directed to appear before the court concerned on all the dates of hearing and as and when called upon to do so.
