This is an application filed under Section 438 and 442 of the BNSS, 2023 praying for quashing of the order dated 06.02.2026 passed in N.I. Case No. 04/2025 registered under Section 138 of the N.I. Act by the learned Chief Judicial Magistrate, Chirang. 3. The petitioner, Fokhoruddin Ali Ahmed is an accused before the court below. He has medical problems. Therefore, he prayed before the Court to dispense with his personal presence before the Court below. 4. The petitioner has submitted that because of his problems, it is difficult for him to travel from Guwahati to Chirang on each and every date, on wheel. 5. I have considered the submissions made by the learned counsel of both the sides in the light of the materials available on record. 6. This Court is of the opinion that the petitioner is at liberty to attend the Trial by video conferencing. The Trial Court is directed to proceed with the trial of the case by video conferencing with the present petitioner in connection with N.I.
