ORAL ORDER
Petitioner is before this court in this petition Preferred under Section 439 of Cr.P.C., praying to enlarge him on bail in Crime No.83/2022 of Chamarajapet Police Station, Bengaluru City, pending in SC.No.231/2023 on the file of the Court of LXIX Additional City Civil and Sessions Judge.
2. Petitioner amongst two other accused is facing trial for the offence punishable under Section 302 and 212 of IPC.
3. Petitioner is arranged as accused No.1 in the charge sheet. He was arrested on 17.07.2022. Accused Nos.2 and 3 are on bail.
4. The learned counsel for the petitioner submitted that the petitioner is languishing in judicial custody for more than three and a half years. Accused Nos.2 and 3 are already

enlarged on bail and therefore, the benefit of bail may be extended to the petitioner, by imposing any conditions.
5. Petitioner had approached this court for bail in Crl.P.No.1368/2023. The said petition was dismissed on 09.06.2023 on merits, considering the entire facts and circumstances of the case and the material against the petitioner.
6. The petitioner has once again approached the Sessions Court for bail which has been now dismissed by the learned Sessions Judge vide order dated 28.06.2025.
7. It is not in dispute that the trial is in progress and out of 38 witnesses cited in the charge sheet, 21 witnesses are already examined.
8. The learned High Court Government Pleader submitted that only the Investigation Officer has to be examined in this case and cross examination of CWs.20 and 21 has to be conducted by the defense.

9. Since the trial is at the fag end and considering that the prayer for bail was rejected by this Court earlier and also considering the prima-facie material at this stage against the petitioner, it is not a fit case to enlarge the petitioner on bail.
Petition is dismissed.
Trial Court shall expedite the trial. I.A.No.1/2026 is disposed of.
