This bail application has been filed on behalf of Vijeta Kumari @ Guddi Kumari @ Guddi @ Gudiya Kumari who is in custody since 24.10.2024 in connection with Daltonganj (Sadar) P.S. Case No. 105 of 2024 corresponding to S.T. No. 72 of 2025 for the offence registered under Sections 103(3), 238 and 3(5) of the BNS, 2023 pending in the Court of learned Addl. Sessions Judge-IX, Palamau at Daltonganj, is pressed into motion.
Earlier bail application of the petitioner was rejected on merit vide order dated 28.08.2025 passed in B.A. No. 2498 of 2025 by Co-ordinate Bench of this Court and instant bail application is being renewed on the ground that although the weapon of offence was recovered on the basis of disclosure statement made by this petitioner which has been relied upon by the prosecution, but in the very same disclosure statement, it was not this petitioner who committed the offence, rather it was Ajit Kumar Singh who had inflicted axe blow to the deceased resulting in his death.
Learned A.P.P. for the State opposed the prayer for bail.
Under the circumstances, the above-named petitioner is directed to be released on bail on furnishing bail bond of Rs.25,000/-(Twenty-Five Thousand) with two sureties of the like amount each to the satisfaction of the Court below.
