This bail application has been filed on behalf of Shiva Singh who is in custody since 25.09.2021 in connection with S.T. Case No. 257 of 2022 arising out of Kurkura P.S. Case No. 04 of 2021 (Spt. G.R. No. 11 of 2022) for the offence registered under Sections 147, 148, 149, 323, 341, 397, 452 of the IPC and Section 17 of C.L.A. Act, pending in the Court of Addl. Sessions Judge-II, Gumla. It is submitted by learned counsel for the petitioner that altogether four persons have been named in the FIR but the petitioner is not named in the FIR. There is no material against the petitioner except the confessional statement made by co-accused Deepak Manjhi @ Jhau, who is named in the FIR and he has been granted bail by the Co-ordinate Bench of this Court. The petitioner is languishing in custody for more than four years and only one witness has been examined. Learned counsel for the State opposed the prayer for bail and submitted that the petitioner has also criminal antecedent. Under the circumstances, the above-named petitioner is directed to be released on bail on furnishing bail bond of Rs.25,000/-(Twenty-Five Thousand) with two sureties of the like amount each to the satisfaction of the Court below.
