JUSTICE M.NAGAPRASANNA ORAL ORDER The petitioner, husband is before this Court calling in question proceedings in C.C.No.72424/2024, pending before the XXIX Additional Chief Judicial Magistrate, Bengaluru, for the offences punishable under Sections 115(2), 118(1), 351(2), 351(3), 352, 85 and 89 of the BNS. 2. Learned counsel for the petitioner and respondent No.2 in unison submit that the parties to the lis were before the family Court in M.C.No.4041/2024 and settled their matrimonial dispute amicably by drawing up certain terms and conditions and therefore, they are before this Court seeking permission to - 3 - HC-KAR NC: 2026:KHC:17431 CRL.P No. 2356 of 2026 compound the afore-quoted offences. The parties have filed a photocopy of the joint compromise petition filed before the concerned family Court and a joint compromise petition of the parties, before this Court. 3. The joint compromise petition reads as follows: “2. The Petitioner had filed Petition for declaring the marriage solemnised between the Petitioner and 2nd Respondent as null and void in M.C.No. 4041/2024, disposed on the file of learned IV Addl. Prl. Family Court, Bengaluru, which has been compromised between the parties by filing joint Petition as per order dated 05-03- 2026. 3. That with the intervention of the friends, family and well. wishers, the parties have amicably resolved their matrimonial disputes voluntarily, without any force, coercion or undue influence. 4. That as part of the settlement arrived at between the parties, the Petitioner has agreed to pay a sum of Rs. 12,00,000/- (Rupees Twelve Lakhs only) to the Respondent towards full and final settlement of all her claims, including maintenance, alimony, and all past, present and future claims arising out of the matrimonial relationship. Accordingly, the Petitioner has already paid Rs.12,00,000/- (Rupees Twelve Lakhs only) to the Respondent by cash. That the Petitioner and the Respondent shall have no further claims of any nature whatsoever against each other in respect of the matrimonial relationship. 6. That the Respondent No.2 has no objection to quash the entire proceedings in respect of Charge Sheet filed in C.C. No. 72424/2024, pending on the file of learned XXIX Addl. CJM at Bengaluru, arose from Cr.No.600/2024 of HAL Police Station. 7. That the parties state that, the present compromise is entered into voluntarily, consciously and in good faith, and they seek disposal of the present petition in terms of this compromise.” In the light of the fact that the parties have arrived at settlement before the family Court and since it is a marital dispute, I deem it appropriate to accept the joint compromise petition of the parties and terminate the proceedings against the petitioner, as the allegations are not against the State. 4. For the aforesaid reasons, I pass the following: ORDER (i) The criminal petition is disposed. - 5 - HC-KAR NC: 2026:KHC:17431 CRL.P No. 2356 of 2026 (ii) The proceedings in C.C.No.72424/2024, pending before the XXIX Additional Chief Judicial Magistrate, Bengaluru, stand quashed.
