The present is a joint application filed on behalf of the plaintiffs and the defendants under Order XXIII Rules 3 and 3A read with Section 151 of the Code of Civil Procedure, 1908 (“CPC”) with a prayer for decreeing the present suit in terms of the Memorandum of Family Settlement dated 25th March, 2023. 2. Learned counsels appearing for the parties submit that since the parties are closely related, the matter was discussed amongst themselves and with intervention of their well-wishers and relations, the parties had agreed to settle the disputes in terms of an oral family settlement. 3. Thus, it is submitted that the matter has been settled by and between the parties in the terms as were agreed upon on 25th March, 2023 by way of This is a digitally signed order. oral family settlement and as duly recorded in the written Memorandum of Family Settlement dated 25th March, 2023. The terms of the same are detailed in Para 4 of the present joint application. 4. Thus, it is submitted that a decree may be passed in terms of the aforesaid Memorandum of Family Settlement. 5. Learned counsels appearing for both the parties jointly submit that the settlement between the parties has been reached without any undue pressure, coercion and duress and that the parties have arrived at the settlement out of their own free will and volition. 6. The aforesaid statement is taken note of. 7. This Court has perused the terms of the Memorandum of Family Settlement dated 25th March, 2023 between the parties, as noted in the present application and annexed therewith, and finds no impediment in accepting the same, with the terms therein, being lawful. 8.
Thus, in view of the aforesaid, this Court finds no impediment in decreeing the suit in terms of the Memorandum of Family Settlement dated 25th March, 2023. 9. Accordingly, with the consent of the parties, a consent/compromise decree is hereby passed in the terms of the Settlement Agreement read with Memorandum of Family Settlement dated 25th March, 2023, and following directions are issued in this regard: i. The parties are hereby bound by the aforesaid Memorandum of Family Settlement, and they shall abide by the terms and conditions, as set out therein. ii. None of the parties shall raise any dispute with respect to the issues which have been settled by way of the Memorandum of Family This is a digitally signed order. Settlement dated 25th March, 2023. 10. Let decree sheet be prepared by the Registry, in accordance with the aforesaid consent terms between the parties. 11. Considering the fact that the parties have arrived at a settlement, the Registry of this Court is directed to issue a Certificate of Refund of full Court Fees to the plaintiffs. 12. Accordingly, the present suit, along with the pending application, stands disposed of. 13. The next dates of 31st July, 2026 and 04th August, 2026 stand cancelled.
