No.21734 of 2026 ORDER: The writ petition is filed under Article 226 of the Constitution of India, to issue a writ, order or direction, more particularly one in the nature of Mandamus, declaring the action of the respondent No. 4 in issuing impugned endorsement vide RCB No. 05 / 2026 dated 04.05.2026 as illegal, arbitrary, violative of the principles of natural justice and Articles 14, 21 and 300-A of the Constitution of India and contrary to the provisions of the Andhra Pradesh Rights in Land and Pattadar Pass Books Act, 1971; and consequently, direct the respondent No. 4 to delete the names of the respondents Nos. 5 to 8 from the revenue records in respect of the lands in survey No. 165/1 to an extent of 8 cents, 4 cents, 16 cents, 12 cents (total extent of 40 cents, survey No. 165/2 extent of 8 cents, 4 cents, 9 cents, 4 cents, (total extent of 33 cents, survey No. 166 extent of Ac. 2.08 cents, Ac. 2.06 cents, Ac. 2.06 cents, Ac. 2.25 cents, (total extent of Ac. 8.45 cents), survey No. 167 extent of Ac. 1.88 cents, Ac. 1.88 cents, Ac. 1.88 cents, 2.50 cents (total Ac. 8.14 cents), survey No. 173/1 extent of 6 cents, 6 cents, 6 cents, (total extent of 18 cents), survey no. 173/2 extent of 6 cents, 6 cents, 6 cents, (total extent of 18 cents), survey No. 173/3 extent of 5 cents, 5 cents, 6 cents (total extent of 16 cents), survey No. 173/4 extent of 5 cents, 5 cents, 6 cents (total extent of 16 cents) situated at Gummalampadu Village, Vaggampalli Gram Panchayt, Pamuru Mandal, Markapuram District (erstwhile Prakasam District) and to pass such other order as this Court may deem fit and proper in the circumstances of the case in the interest of justice. 2. 2. Sri G. Divyatheja, learned Assistant Government Pleader for Revenue, placed on record a copy of written instructions of the 3 W.P. No.21734 of 2026 respondent No. 4, vide Rc.DT / 123 / 2026, dated 07.08.2026, wherein at paragraph Nos. 5 and 6 it is stated as below: “The lands covered by the writ petition are not included in the prohibited properties list under Section 22-A of the Registration Act, 1908. The request of the petitioners for deletion of the names of the respondents Nos. 5 to 8 cannot be acceded to at a stretch, unless and until the contrary of ryothwari pattas are proved. However, the files regarding ryothwari pattas are not traced in the office of this respondent and therefore, the ryothwari patas produced by the respondents Nos. 5 to 8 will be referred to the component authority i.e., Joint Collector, Markapuram and after ascertaining its genuineness, appropriate action will be taken in the matter ” 3. The learned counsel for the petitioners submitted that the impugned proceedings in the writ petition No. 4254 of 2019, which was mentioned in the impugned endorsement dated 14.05.2026 had been withdrawn in February, 2026, much before the date of the endorsement, whereas, the inability to take action on 14.05.2026 was referred to the pendency of the said writ petition. He further submitted that as it was filed by some third parties, it could not be brought to the notice of the concerned authorities at the time of passing the endorsement and that necessary steps would be taken to represent the same to the respondent No. 4 by enclosing a copy of the order in answer to the impugned endorsement, with a further request to examine the issue afresh. 4 W.P. No.21734 of 2026 4. Accordingly, the writ petition is disposed of granting liberty to the petitioners to make appropriate representation to the respondent No. 4 along with necessary documents. Upon such representation being made, the respondent No. 4 shall take action within one (01) month thereafter.
