The present writ petition has been filed for the following reliefs :- “(a) for for the issuance of appropriate Writ, Rule or Direction against the respondents, especially the Deputy Commissioner, Dhanbad (Respondent No.2) to ensure and protect the right of property of the petitioner which is being illegally and arbitrarily curtailed by the Circle Officer, Nirsa, Dhanbad (Respondent No.4) in collusion and connivance with the private respondent (Respondent No.5) who has made illegal construction of shops over the public "Rasta" apertaining to Khata No.42, Plot no.28 putting obstruction to the petitioner for his ingress and egress on the land of Plot No.27 (old survey which is now Plot No.24 under New Survey), Khata No.39. - 1 - W.P.(C) No.6881 of 2025 2026:JHHC:1162 (b) further prays that the illegal encroachment by constructing "Kachcha" Shops by the Respondent No.5 on the public land disturbing the petitioner's movement in his own land be removed with the help of District Administration..” 2. No notice is required to be issued upon the private respondent in view of the confinement of the prayer by the learned counsel for the petitioner. Now, the petitioner has prayed only for issuance of direction upon the respondent for conclusion of M.P Case No.1205 of 2009, pending before the respondent No.3 i.e. the Sub Divisional Officer, Dhanbad. 3. In view of above limited submission, the present writ petition is, hereby, disposed of directing the respondent No.3 to culminate the proceeding of M.P. Case No.1205 of 2009 as early as possible, after giving due opportunity of hearing to all the necessary parties. 4. Keeping the matter pending for such a long period is against the rule of law and that should be kept in mind by the learned Sub Divisional Officer, Dhanbad. 5. With above observation and direction, the present writ petition is, hereby, disposed of. 6. Pending interlocutory application, if any, stands disposed of.
