Das … … for the petitioner Mr. Partha Pratim Das Ms. Smita Saha … … for the State Learned advocate appearing for the petitioner submits that there has been recovery of 27 bottles of phensedyl from the joint possession of the petitioner and another. Petitioner is in custody for 7 months. Charge-sheet has already been filed. As such, the petitioner may be released on bail on any stringent condition. Learned advocate appearing for the State opposes the prayer for bail and submits that 33 bottles of phensedyl were recovered. I have taken into account the quantity of seizure in the present case and detention of the petitioner already suffered and as such having considered the same, I am of the view further detention of the petitioner is unwarranted in the facts and circumstances of the case. Accordingly, the prayer for bail of the petitioner is allowed. The petitioner shall be released on bail upon furnishing bond of Rs.20,000/- (Rupees Twenty Thousand only) with two sureties of Rs.10,000/- each, one of whom must be local to the satisfaction of the learned Judge, Special Court under NDPS Act cum Additional District Judge, Dakshin Dinajpur at Balurghat. If on bail, the petitioner shall be physically present on each and every date fixed before the learned trial court and shall not leave the district of Dakshin Dinajpur without the prior permission of the learned Special Court.
