3. Mrs. Meenakshi Sharma, learned AGA for the State.

Present applicant-Ajay Sharma, S/o Shri Gopal Lal Sharma, who is aged about 23 years, is praying for bail in reference to a First Information Report dated 18.06.2025 being FIR No.0016 of 2025, P.S. Joshimath, District Chamoli wherein the present applicant was implicated for the offence punishable under Section 376 of IPC.
5. On the basis of the FIR, the applicant was arrested on 10.10.2025 and since then he is languishing in jail. On completion of investigation, the charge sheet was filed on 22.11.2025 wherein the applicant has been charge sheeted for the offences punishable under Sections 354(a), 376(2)(n), 506 of IPC read with Section 3(2)(v) of the SC/ST Act.
6. It is argued by learned counsel for the applicant that applicant is innocent; has been falsely implicated; the charge sheet has been filed in a mechanical manner despite of the fact that the relations in between the applicant and victim, was consensual and for 10-15 days the victim
was with the applicant and she has not made any complaint. He also submits that the victim is about 29 years old and the applicant is only 23 years and on careful scrutiny of the FIR, it reveals that on the false pretext of marriage, the applicant has been implicated. He further submits that the present applicant is languishing in jail since 10.10.2025 and charge sheet has already been filed; he has no criminal antecedents and since now the charge sheet has been filed, there is no need of further custodial interrogation of the present applicant.
7. On the other hand, learned counsel for the complainant submits that on the false pretext of marriage, the applicant make sexual assault with the victim, however she has not disputed that the charge sheet has already been filed.
8. Mrs. Meenakshi Sharma, learned AGA has also not disputed that the charge sheet has already been filed and the applicant has no previous criminal antecedents and is languishing in jail since
10.10.2025.
9. After hearing the submission of
learned counsel for the parties and taking into consideration that the investigation has already been completed and the present applicant is languishing in jail since 10.10.2025 and has no criminal antecedents, this Court is of the view that the applicant deserves for bail.
10. Accordingly, without expressing any opinion on the merit of the case, the bail
application is allowed.
11. Let the present applicant-Ajay Sharma be released on bail on his executing a personal bond and furnishing two reliable sureties of the like amount to the satisfaction of the court concerned.
