Present applicant Sukhvinder Singh, S/o Kashmir Singh is praying for bail in relation to FIR dated 22.03.2026 bearing FIR/Case Crime NO. 142 of 2026 P.S. Sitarganj District U.S. Nagar wherein on completion of investigation the applicant has been charge sheeted for the offences punishable under Sections 351(3) and 74 of BNS 2023 (corresponding section 376 and 504 IPC). 4. It is argued by the learned counsel for the applicant that the applicant is innocent and has been falsely implicated which is evident from the fact that few days back from the date of lodging of the FIR, the applicant made a complaint against the brother of the victim with regard to some property dispute and being prejudice with this complaint, the victim who is, in fact, is the step daughter of the applicant lodged the FIR. She further argued that in fact the allegation as alleged are not true and even otherwise the relationship, if any, are consensual one, therefore, no offence is made out. She further argued that the investigation has already UKHC010076722026 2026:UHC:5988 been completed and the charge sheet has been filed and the present applicant has no criminal antecedent which has not been denied by the State in their objection. 5. On the other side, learned counsel for the State have not disputed that the investigation has already been completed and the applicant has no criminal antecedent, however, he submits that after collecting all credible evidence charge sheet has been filed. 6. After hearing the submissions of the learned counsel for the parties and taking into consideration that the present applicant is languishing in jail since 24.03.2026 and the charge sheet has already been filed, therefore, this Court is of the view that the applicant deserves for bail. 7. Accordingly without expressing any opinion on the merit of the case, the bail application is allowed. 8. Let the applicant Sukhvinder Singh be released on bail on his executing a personal bond and furnishing two reliable sureties of the like amount to the satisfaction of the court concerned.
