Madhupur dated 14.11.2025 passed by Sub- Divisional Officer, Madhupur, Deoghar/Respondent No.3 directing to official respondents to remove the 2026:JHHC:12340 2 encroachment over the land under the Jamabandi No.23, Plot No.72, Area- 2.29 acres, Mouza – Guniasole, Thana- Madhupur, District Deoghar, which are belongs to the present petitioner and his co-sharer; ii) For staying the order dated 12.11.2025 passed vide Gyapank No.1031/D.B. Madhupur dated 14.11.2025 passed by Sub-Divisional Officer, Madhupur, Deoghar/Respondent No.3 till disposal of Original Suit No.56/2024 pending in the Court of Learned Civil Judge (Senior Division)-I, Madhupur, Deoghar filed by the petitioner.” 2. Heard learned counsel representing the petitioner and learned counsel representing the respondents. 3. Admittedly, the Original Suit No.56 of 2024 is pending before the Civil Judge (Senior Division)-I, Madhupur, District Deoghar. 4. When the Civil Suit is pending, the petitioner should have approached the Civil Court in the said Civil Suit, for redressal of his grievance, rather he has rushed to this Court under Article 226 of the Constitution of India, by challenging the order as contained in Memo No.1031 dated 14.11.2025 (Annexure-9 to the writ petition). 5. Since the aforesaid Civil Suit is already pending, I am not inclined to entertain this writ petition. 6. Accordingly, this writ petition stands dismissed. 7. However, the petitioner is at liberty to approach the Civil 2026:JHHC:12340 3 Court seeking appropriate relief, where the Civil Suit being Original Suit No.56 of 2024, is still pending. 8.
