1. This bail application has been filed by the accused-petitioner under Section 483 of BNSS in connection with FIR No.110/2025 registered at Police Station Nagar, District Deeg for offence(s) under Section(s) 319(2), 318(4), 338, 336(3), 340(2), 111(2)(4) (5), 313 & 61(2)(a) of BNS and Section 66-D of IT Act.

Learned counsel for the petitioner submits that the accused- petitioner has been falsely implicated in this case and he has nothing to do with the alleged offences. Learned counsel further submits that petitioner has not been named in the FIR and he has been implicated in this case merely on the basis of statement of co-accused. Learned counsel also submits that co-accused namely Afsar, has already been enlarged on bail by a Coordinate Bench of this Court, vide order dated 27.06.2025, in S.B. Criminal Misc. Bail Application No.7642/2025.

Learned counsel further contends that the petitioner is in custody since 14.01.2026, no recovery is required to be made from him and investigation / trial will take considerably long time in its conclusion, so no fruitful purpose would be served by keeping the petitioner in custody, therefore, petitioner may be enlarged on bail.
4. Per contra, learned Public Prosecutor opposes the bail application.

Having regard to the facts and circumstances of the case; considering the arguments advanced by learned counsel for the petitioner, the fact that co-accused has already been enlarged on bail; investigation / trial will take considerably long time in its conclusion, without commenting anything upon the merits / demerits of the case, this Court deems it just and proper to enlarge the petitioner on bail.

Therefore, this bail application is allowed and accused- petitioner, namely Abbas S/o Noor Mohammad is ordered to be released on bail, provided, he furnishes a personal bond in the sum of Rs.50,000/- with two sureties of Rs.25,000/- each to the satisfaction of the Trial Court, with the stipulation that the petitioner shall appear before that Court on all subsequent dates of hearing and as and when called upon to do so.
