This matter is taken up through Hybrid Arrangement (Virtual /Physical Mode). 2. Heard learned counsel for the Petitioners as well as learned counsel for the State-Opposite Party. Perused the Anticipatory Bail Application as well as the F.I.R. 3. The present application has been filed under Section 482 of B.N.S.S., 2023 by the Petitioners seeking pre-arrest bail in connection with Morada P.S. Case No.312 of 2025, corresponding to C.T. Case No.305 of 2025, pending in the court of the learned J.M.F.C., Morada, registered for alleged commission of offences punishable under Sections 303(2)/3(5) of BNS, 2023 read with Section 12 of the Orissa Mineral (Prevention of Theft Smuggling Page 2 of 2. and Other Unlawful Activities) Act, 1988. 4. Learned counsel for the Petitioners, at the outset, submitted that the Petitioners do not want to press this bail application and seek liberty to surrender before the court below and move an application for bail. 5. Considering such submission, the Petitioners are permitted to surrender before the court in seisin over the matter within a period of four weeks from today and move an application for bail. In such eventuality, the court in seisin over the matter shall release the Petitioners on bail on such terms and conditions as it may deem just and proper in the facts and circumstances of the case. 6. While imposing conditions, the court in seisin over the matter shall also impose conditions whereby the Petitioners shall cooperate with the investigation and shall appear before the I.O. as and when their presence is required by the I.O. for the purpose of investigation; they shall not indulge in similar criminal activities while on bail; they shall appear before the trial court on each and every date of posting of the case, unless their personal appearance is dispensed with by the trial court. Violation of any of the conditions imposed either by this court or the court in seisin over the matter shall entail cancellation of bail. 7. It is further directed that the bail granted to the Petitioners subject to depositing a cash security of Rs.3,000/- (Rupees Three Thousand) each before the court in seisin over the matter, which shall be kept in any Nationalized Bank in interest bearing account Page 3 of 3. initially for a period of one year which will be renewable from time to time till conclusion of trial and the same shall be abide by the final outcome of the trial of the case. 8.
