JUSTICE ASHOK KUMAR PANDEY ORAL ORDER 2 17-04-2026 Heard learned counsel for the petitioner and learned APP for the State. 2. The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 103(1) and 3(5) of BNS. 3. The case of the prosecution is that the petitioner along with others arrived at the door of the informant and started abusing and assaulting the husband of the informant with lathi due to which he fell down and all the accused persons assaulted with fists and feet. The husband of the informant died on the way to hospital. It is alleged in the FIR that there is a land dispute between two full brothers, the husband of the informant and one co-accused Bharat Bhushan Singh. It is also alleged that the son of Bharat Bhushan Singh has assaulted with lathi and

Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. Learned counsel for the petitioner has submitted that from perusal of the postmortem report, it will transpire that ante-mortem injuries of the deceased was only abrasions and the doctor has opined that the cause of death is cardiac arrest. The antemortem injuries are not sufficient to cause death as they are only abrasions. As per the FIR, this petitioner has assaulted with lathi but the injuries of the deceased are of abrasions. Learned counsel has further submitted that other co-accused persons have already been granted bail by this court vide Cr. Misc. No. 14754 of 2026. Moreover, the petitioner is languishing in judicial custody since 06.11.2025 having no criminal antecedent. 5. Learned APP appearing for the State has vehemently opposed the prayer of regular bail. 6.
Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Sambhuganj P.S. Case No. 290 of 2025 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like
