Page No.# 4/5 2. Heard Mr. H R A Choudhury, the learned Senior Counsel assisted by Mr.A Z Ahmed appearing for the petitioners. Also heard Mr.P Borthakur, the learned Additional Public Prosecutor for the state of Assam. 3. These two applications are filed under Sections 482 & 483 of the BNSS, 2023 seeking pre-arrest bail as well as regular bail in respect of Mankachar P.S. Case No. 39/2026. 4. On 20.03.2026, at about 6 PM, the informants’ side and the petitioners’ side had an attack and counter attack with sharp weapons. Some persons were seriously injured. It may be mentioned that some persons of both sides had sustained serious injuries. The present petitioners’ side also lodged an FIR before police against the informants’ side, which was registered as Mankachar P.S. Case No.50/2026 and in that case police has filed a charge-sheet. 5. The injured persons implicated all the petitioners except the petitioners, namely, 5. Aysha Khatun, 6. Azeda Khatun, 8.Monzil Hussain @ Monjil Hoque and 9. Monir Jamal @ Babu of AB No.1006/2026. 6. Considering the aforesaid facts, this Court is of the opinion that apart from these four petitioners, none of the petitioners deserves to be given any relief at this stage. 7. Therefore, the bail prayer of the petitioner, namely Mofidur Hussain @ Moidur Rahman of Bail Appln.1303/2026 is rejected. 8. The pre-arrest bail prayer of the petitioners, namely, 1. Mominur Islam, 2. Monowar Hussain, 3. Mofizur Hussain @ Mofizur Rahman and 4. Anowar Hussain of AB No.1006/2026 are also rejected. 9. It is hereby directed that in the event of arrest of the petitioners, namely, petitioners Nos. 5. Aysha Khatun, 6. Azeda Khatun, 8. Monzil Hussain @ Monjil Hoque Page No.# 5/5 and 9. Monir Jamal @ Babu of AB No.1006/2026 shall be released on bail of Rs. 25,000/- each with sureties of like amount to the satisfaction of the arresting authority. 10. All the four petitioners, namely, 5. Aysha Khatun, 6. Azeda Khatun, 8. Monzil Hussain @ Monjil Hoque and 9. Monir Jamal @ Babu of AB No.1006/2026 shall cooperate with the Investigating Officer as and when called for. With the aforesaid direction, both the bail applications are disposed of.
