According to the petitioner, he is practicing as a medical lab technician since 1998, as he obtained Diploma in Medical Laboratory Technology from a private college, namely, Institute of Public Health and Hygiene, Delhi, in the year 1998. His further case is that he subsequently passed B.Sc. in Medical Lab Technology from NIMS University, Jaipur, Rajasthan in the year 2011 and he continued to practice as medical lab technician in State of Uttarakhand. 3. Petitioner’s name was earlier registered UKHC010117992026 2026:UHC:5648 with Uttarakhand Para Medical Council in the year 2016, which was valid for five years; he applied for renewal of registration, which is not being granted. 4. Petitioner contends that his case is protected by Section 20(3) of Para Medical Council Act, 2009, as he was practicing as a medical lab technician on the date of enforcement of the said Act. 5. It is contended that the Act was enforced only in the year 2014 and that time, petitioner was practicing as medical lab technician. 6. Learned counsel appearing for Para Medical Council submits that if petitioner makes representation, the issue raised by him shall be dealt with, as per law. 7. The writ petition is, accordingly, disposed of with liberty to petitioner to make representation. If he makes representation to the competent authority within one week from today, decision thereupon shall be taken, as per law, within eight weeks thereafter.
