The petitioner is apprehending his arrest in connection with Kersai P.S. FIR NO. 04/25, for offences U/S 20(b)(ii) (c) and 22(c) of Narcotic Drugs and Psychotropic Substances Act, 1985, pending in the court of learned Sessions Judge cum Special Judge, Simdega. 3. Learned counsel appearing for the petitioner submits that the petitioner has been falsely implicated in this case and the petitioner has not purchased the Renault Duster car from the showroom of the Toyota Heritage, Ormanjhi. He submits that the petitioner is a lady and she is a housewife and she is residing in the district of Buxar in state of Bihar. He also submits that the petitioner is blessed with a baby child on Caesarean on 15.11.2024, wherein the allegation in the present case is made on 15th January 2025. He also submits that even she is having several ailments. He next submits that the petitioner is nothing to do with the seized cannabis. He also submits that the petitioner has got no criminal antecedent as disclosed in Para-5 of the petition. In this view of the matter, the petitioner may kindly be 2026:JHHC:3224 2 granted anticipatory bail. 4. Learned counsel appearing for the State opposed the prayer and submits that in the investigation, it is revealed that the said vehicle has been sold by a sale letter to this petitioner and the husband of the petitioner is also accused in the present case, against whom Section 84 B.N.S.S. process has already been issued and the cannabis is commercial in quantity. 5. It transpires that the petitioner is a resident in the district of Buxar, Bihar and she is blessed with a child on 15.11.2024, whereas the car has been seized on 15.01.2025. The manager of the showroom of Renault Heritage, Ormanjhi has stated that the car has been sold by way of sale letter in the name of the petitioner, however, there is no sale letter on record. Even if it presumes that the said vehicle was purchased in the name of the petitioner, prima facie, it appears that mischief has been done by the husband of the petitioner and Section 84 of B.N.S.S. has already been issued against the husband of the petitioner and it has been stated in Para-5 of the petition that the petitioner has got no criminal antecedents. I am inclined to grant anticipatory bail to the petitioner. 6. Accordingly, the petitioner, above named, is directed to surrender before the learned Court within three weeks from the date of receipt of the order and on the event of her surrender / arrest, she shall be released on bail on furnishing bail bond of Rs.25,000/- (Twenty-Five Thousand) with two sureties of the like amount of each to the satisfaction of learned Sessions Judge cum Special Judge, 2026:JHHC:3224 3 Simdega, in connection with Kersai P.S. FIR NO. 04/25, subject to the condition as laid down under Section 482(2) of Bharatiya Nagarik Suraksha Sanhita, 2023. 7. This Anticipatory Bail Application is accordingly allowed and disposed of.
