SUNDAR HON'BLE MR. JUSTICE AHANTHEM BIMOL SINGH (ORDER) (Order of the Court was made by Mr. M. Sundar, CJ) 27.08.2026 [1] Mr. L. Romen, learned counsel on record for appellant and Mr. Kh. Samarjit, learned senior advocate and DSGI (Deputy Solicitor General of India) instructed by Mr. N. Nongdamba, learned counsel for respondent NIA are before this Court. [2] One of the captioned MCs (Miscellaneous Cases) namely, MC (Cril. A.) No. 34 of 2026 has been taken out with a prayer to withdraw captioned main appeal i.e., Cril. A. No. 11 of 2026. [3] Mr. L. Romen, learned counsel on record for MC applicant who is before this Court submits that a typographical error has crept in qua the prayer and year of the Criminal Appeal has been wrongly shown as ‘2025’. Learned counsel regrets the error and requests this Court to treat captioned MC (Cril. A.) No. 34 of 2026 as ‘MC with the prayer to withdraw Cril. A. No. 11 of 20226’ i.e., to withdraw captioned Criminal Appeal. This request is acceded to. [4] Issue notice in afore-referred MC (Crl.A.) No. 34 of 2026. [5] Mr. N. Nongdamba, accepts notice for lone respondent NIA (National Investigation Agency) and Mr. Kh. Samarjit, learned senior advocate and DSGI who is leading him is in Court. [6] Mr. Nongdamba, led by learned Deputy Solicitor submits on instructions that captioned MC (Cril. A.) No. 34 of 2026 is not opposed. This submission is recorded. 3 [7] Be that as it may, as regards the reason for withdrawal, Mr. L. Romen, submits that a second bail application has been filed in the Trial Court on health grounds, appellant wants to pursue the second bail application and therefore, withdrawal of captioned appeal which is directed against rejection of first bail application is sought. Request acceded to. [8] Mr. L. Romen, further submits that withdrawal of captioned Criminal Appeal will also mean withdrawal of Captioned MC thereat, i.e., MC (Cril. A.) No. 32 of 2026. This submission is also recorded. [9] While permitting withdrawal of captioned Criminal Appeal and MC thereat, this Court makes it clear that the second bail application on health grounds said to have been filed by the appellant (if already filed or filed post instant order) the same shall be dealt with and disposed of on its own merits and in accordance with law by the Trial Court untrammeled by withdrawal of captioned Criminal Appeal vide instant order. [10] Ergo, the sequitur is: i) Captioned MC (Cril. A.) No. 34 of 2026 is allowed. There shall be no order as to costs. ii) Criminal Appeal No. 11 of 2026 and MC (Cril. A.)
