(Oral) By means of the present writ petition, petitioner has sought a writ of mandamus commanding the respondents to correct his date of birth in the service record of his father-Late Shri Charan Singh as per the documents in possession of the petitioner. 2. Learned counsel for petitioner submits that petitioner’s father-Late Charan Singh was working in Government Press, Roorkee under the control of respondent No.2 who retired on superannuation, but subsequently died on 18.03.2016. Petitioner’s mother had already expired prior to his father in the year 1995. Petitioner being 60% handicap made a request to respondent No.2 to grant family pension to him, but due to wrong mention of his date of birth in service book of his father, same was not granted to him. 3. Learned counsel for petitioner further submits that correct date of birth of petitioner is 12.02.1995 while in service book of petitioner’s father, it is mentioned as 22.02.1995. He placed reliance upon the School Leaving Certificate as well as the Birth Certificate (Annexure No.4 UKHC010121032026 2026:UHC:6043 2 to the writ petition). Petitioner wants respondents to enter the correct date of birth in the service book of his father. 4. Petitioner did not move any representation to respondent No.2 before filing the present writ petition before this Court, which is sine qua non for praying writ of mandamus. 5. In such view of the matter, instead of directing respondent No.2 to correct the date of birth of the petitioner in service book of his father, petitioner is at liberty to move a representation along with the proof of his date of birth i.e. School Leaving Certificate and Birth Certificate therewith, within a period of 10 days from today. 6. If such representation is moved by petitioner within 10 days from today, respondent No.2-Director, Government Press, Roorkee, District Haridwar, shall take decision thereon, in accordance with law, on the basis of documents annexed by petitioner as proof of his date of birth along with representation, within two weeks’ from the date of receipt of representation. 7. In view of the above, the writ petition is disposed of.
