Mrs. Archana Rawat was elected as Member Kshetra Panchayat, Vikasnagar against a seat reserved for OBC candidate in the last election held in the month of July, 2025. One Aman Kumar Kashyap filed Writ Petition No. 2111 of 2025 (MS), questioning the caste status of Archana Rawat. The said writ petition was disposed of with a direction to District Magistrate to take decision on the representation made by Aman Kumar Kashyap. 3. Petitioner is aggrieved by the order passed by District Magistrate, Dehradun on 26.09.2025, whereby the representation made by Aman Kumar Kashyap was disposed of in view of understanding arrived at between Mr. Aman Kumar Kashyap and Smt. Archana Rawat. 4. Petitioner contends that he had also made a similar representation questioning caste status of Smt. Archana UKHC010124732026 2026:UHC:6044 Rawat, therefore his representation could not have been disposed of based on a settlement arrived at between Archana Rawat and Aman Kumar Kashyap. 5. Learned State Counsel as well as Mr. Sanjay Bhatt, learned counsel appearing for State Election Commission, however, submit that petitioner contested the election and he lost and he has challenged election of Smt. Archana Rawat in election petition, which is pending before learned District Judge, Dehradun. It is thus contended that since petitioner has approached the appropriate forum available to him in law, therefore, grievance raised by petitioner in this writ petition is without any substance. 6. This Court finds substance in the said contention. 7. Since petitioner has availed the remedy available in law and he is before a judicial forum which will examine the allegations as to whether Smt. Archana Rawat belongs to OBC category or not, therefore petitioner cannot be permitted to short-circuit the judicial process by seeking a direction from this Court to the District Magistrate. 8. Thus, there is no scope for interference in the matter. The writ petition fails and is dismissed.
