The present bail application has been filed by the accused- applicant under Section 483 of the B.N.S.S, 2023 against the order dated 15.04.2026 passed by learned Sessions Judge, Alwar in connection with FIR No. 146/2026 registered at Police Station Malakheda District Alwar for the offences punishable under Sections 317(2), 317(4), 318(2), 318(4), 112(2) & 61(2)(a) of BNS & Section 66D of I.T.(Amendment) Act, 2008, by which the bail application of the accused-applicant under Section 483 of the B.N.S.S, 2023 has been dismissed. 2. Learned counsel for the accused-applicant submits that the accused-applicant has falsely been implicated in this case. Learned counsel further submits that during the investigation nothing has been found against the accused-applicant with regard to any kind [2026:RJ-JP:22809] (2 of 3) [CRLMB-6323/2026] of cyber fraud committed through his bank account. Learned counsel further submits that the accused-applicant is 20 years old boy and is appearing in BSF Agniveer Examination. Learned counsel contends that accused-applicant is behind the bars, since his arrest on 08.04.2026 and trial will take considerable time to conclude. Learned counsel further contends that no other criminal case has been registered against the accused-applicant, therefore, it is prayed that the accused-applicant may be enlarged on bail. 3. Learned Public Prosecutor has vehemently opposed the bail application. 4. Heard and perused the material available on record. 5. Having regard to the facts and circumstances of the case and considering the facts that the accused-applicant is behind the bars since 08.04.2026; the accused-applicant is 20 years of age; the offences levelled against the accused-applicant are triable by the Magistrate; there is no criminal antecedents against the accused- applicant and trial will take long time to conclude, but without expressing any opinion on the merits/demerits of the case, this Court deems it proper to allow the bail application filed by the accused-applicant. 6. Consequently, this bail application filed under Section 483 of the B.N.S.S, 2023 is allowed. It is ordered that accused-applicant Rakesh Yogi S/o Surendra Yogi, arrested in FIR No. 146/2026, registered at Police Station Malakheda, District Alwar shall be released on bail; provided he furnishes personal bond in the sum of Rs.1,00,000/- and two solvent attested sureties of Rs.50,000/- each to the satisfaction of the learned trial Court. Applicant shall [2026:RJ-JP:22809] (3 of 3) [CRLMB-6323/2026] be required to appear before that Court on all dates of hearing and as and when called upon to do so. 7. The accused-applicant is also directed to mark his presence in third week of every month till conclusion of trial, before the concerned Police Station. SHO of the concerned Police Station shall send such report, of the accused-applicant, to learned trial Court every month. In case of any breach of the above condition, the State shall be free to move an application for cancellation of bail. 8. Copy of this order also be sent to the concerned SHO for compliance.
