The applicant has filed this 3rd bail application under Section 483 of Bhartiya Nagarik Suraksha Sanhita 2023 for grant of regular bail as he has been arrested on 7-1-2020 in connection with Crime No. 6 of 2020 registered at Police Station Tikrapara, District Raipur for the offence punishable under section 302/34 of IPC and Section 25/27 of the Arms Act.. First bail application of the applicant was dismissed as withdrawn on 17-8-2021 with liberty to file afresh as and when occasion arises and second bail application of the application was dismissed as withdrawn on 5-5-2025 with liberty to 2 revive the same at an appropriate stage. 2. In pursuance of earlier direction given by this Court, Mr. Sandeep Patel, Deputy Commissioner of Police, Raipur has appeared before this Court through video conferencing and would submit that warrant of arrest was issued to witness Savita Devi Jaiswal for securing her presence and now the matter was fixed for 4-2-2026 for recording evidence and on that day they will make all their sincere efforts to see that the witness should present before the trial Court. He would further submit that so far as witnesses Devendra Verma and Vishnu Tiwari are concerned, Devendra Verma has already been examined on 12-1-2026 and Mr. Vishnu Tiwari will be examined in all probabilities on 4-2-2026. He would further submit that they have already served summons on new address of witness Ashish Goyal which they have found out and according to him, there will be no difficulty in carrying out the further evidence of Ashish Goyal on 4-2-2026. 3. This Court has directed Mr. Sandeep Patel, Deputy Commissioner of Police, Raipur to see that all the witnesses shall remain present before the trial Court on 4-2-2026 positively. 4. In view of the fact that the evidence has already been started, learned counsel for the applicant seeks permission of this Court to withdraw this bail application with liberty to file a fresh bail application after examination of some witnesses. 5. Permission is granted. 6. Accordingly, the third bail application filed by the applicant is disposed of with the aforesaid liberty granted to the applicant.
