By means of the present writ petition, the petitioner has challenged the Transfer Order dated 30- 06-2026 (Annexure No.4 to the writ petition) issued by the respondent no. 2/ District Panchayati Raj Officer, District Uttarkashi, whereby the petitioner has been transferred from Block Purola to Block Bhatwari under the compulsory transfer from accessible area to remote area under the provisions of the Uttarakhand Annual Transfer for Public Servants Act, 2017.

The petitioner has impugned the transfer order mainly on the ground that petitioner’s daughter, aged about four years, since birth, is suffering from ‘Brachial Plexus Palsy’ and she had to undergo two major surgeries when she was six months’ of age only. In support of his contention, medical prescription issued by the All India Institution of Medical Science, Rishikesh (Annexure-3 to the writ petition) has been annexed. 1

It is contended that for the purpose of treatment of her daughter, the petitioner should be kept out of the purview of the annual compulsory transfer.

Be that as it may, no legal ground is available to the petitioner to maintain the present writ petition. However, since the petitioner moved a representation to District Panchayat Raj Officer, Uttarkashi on 06.07.2026 (Annexure-5 to the writ petition), a direction may be issued to the respondent no.2 to decide the representation submitted by the petitioner within a stipulated period if not already decided.

Learned counsel for the respondent/State has no objection if such a direction is issued to the respondent no.2.

Accordingly, the writ petition is disposed of finally. The respondent no.2/DPRO, Uttarkashi is
directed to take decision upon the representation of the petitioner dated 06.07.2026 (Annexure-5 to the writ petition) within a period of 10 days from today by passing a reasoned and speaking order.

Let a copy of this order be issued to the petitioner today itself as per rules.
