The petitioner is apprehending his arrest in connection with Penk Narayanpur P.S. Case No. 46 of 2024, registered for the offence under Sections 274, 275, 292, 318(4), 338, 336(3), 340(2) of Bharatiya Nyaya Sanhita, 2023 and Section 47(a) of Jharkhand Excise Act, 1915, pending in the court of learned Additional Chief Judicial Magistrate, Bermo at Tenughat. 3. Learned counsel appearing for the petitioner submits that the alleged articles have been recovered from the house of one Jamuna Ganjhu and the name of the petitioner has been inserted only on the basis of suspicion, as the villagers have stated the name of this petitioner. He next submits that the name of the person, who has taken the name of this petitioner has not been disclosed in the FIR. He further submits that the petitioner is having no criminal antecedent and disclosure to that effect has been made in para-42 of the case diary. He also submits that the co-accused has been granted anticipatory bail in A.B.A. No.6549 of 2025. 4. Learned A.P.P. appearing for the State has opposed the prayer and submits that the name of the petitioner was levelled by the unknown source. 5. Considering that the recovery has not been made from the possession of this petitioner and recoveries have been made from the house of one Jamuna Ganjhu and further the person, who has taken 2026:JHHC:13364 the name of this petitioner, that person name has not been disclosed in the FIR and the petitioner is having no criminal antecedent and disclosure to that effect has been made in para-42 of the case diary and in identical situation co-accused has been granted anticipatory bail by this court, I am inclined to grant anticipatory bail to the petitioner. 6. Accordingly, the petitioner, named above, is directed to surrender before the learned court within four weeks from today and in the event of her surrender / arrest, the petitioner, named above, shall be released on bail, on furnishing bail bonds of Rs. 25,000/- (twenty- five thousand), with two sureties of the like amount each, to the satisfaction of learned Additional Chief Judicial Magistrate, Bermo at Tenughat, in connection with Penk Narayanpur P.S.
