(At Present Confirmed In Sub Jail Bhawani Mandi). ----Petitioner Versus The State Of Rajasthan, Through PP ----Respondent For Petitioner(s) : Mr. Bal Ram Vashisth For Respondent(s) : Mr. Vijay Singh Yadav, PP HON'BLE MR. JUSTICE RAVI CHIRANIA Order 20/05/2026 1. The instant bail application has been filed by the petitioner Wasim S/o Naushad Bhai @ Naushad under Section 483 BNSS (439 Cr.P.C.), who was arrested by the police in connection with the FIR No.58/2026 dated 08.02.2026 registered at Police Station Bhawani Mandi, District Jhalawar for the offences punishable under Sections 8, 22 and 29 of the NDPS Act, 1985. 2. Learned counsel for the petitioner submits that he has one antecedent of the year 2020 under the RPGO Act. Apart from that, there are no criminal antecedents against the petitioner including under the Act of 1985. In view thereof, he prayed that the petitioner be enlarged on bail by granting the benefit of Section 483 BNSS, 2023. [2026:RJ-JP:21299] (2 of 3) [CRLMB-7718/2026] 3. Learned Public Prosecutor could not dispute the fact that there are no criminal antecedents against the petitioner under the NDPS Act, 1985. 4. This Court noted that the alleged contraband substance has been quantified as 10 gms along with the polythene bag and the commercial quantity for the same is 10 gms under the Act of 1985. Prima facie, it appears that the weight of the contraband along with the polythene bag is below the commercial quantity. In view of the fact that there are no criminal antecedents including under the NDPS Act, 1985, this Court is inclined to enlarge the present petitioner on bail. 5. Accordingly, the bail application preferred on behalf of the petitioner is allowed and it is directed that accused-petitioner Wasim S/o Naushad Bhai @ Naushad shall be released on bail, provided he executes a personal bond in a sum of Rs.1,00,000/- with two sound and solvent sureties of Rs.50,000/- each to the satisfaction of learned Trial Court for his appearance before that Court on each and every date of hearing and whenever called upon to do so till the completion of the trial. 6. It is further directed that in case, the petitioner is found to be involved in any case of NDPS Act during the pendency of the trial of the case, learned Public Prosecutor shall file an application for cancellation of this bail, without any fail. 7. The petitioner shall also mark his presence twice, a month (i.e. after every 15 days) at the concerned Police Station. The concerned SHO shall maintain a register of his attendance. In case the petitioner do not mark his presence in any month (i.e. two times in a month), same would be a breach of this order. In that [2026:RJ-JP:21299] (3 of 3) [CRLMB-7718/2026] situation, learned Public Prosecutor shall file application for cancellation of this bail. 8. It is made clear that the observation as made by this Court in the bail application will not prejudice the trial. (RAVI CHIRANIA),J 31/RAHUL KUMAR
