JUSTICE LALITHA KANNEGANTI - 3 - HC-KAR NC: 2026:KHC:20629 WP No. 16677 of 2021 ORAL ORDER The writ petition is filed seeking the following prayer: a) Issue a writ in the nature of mandamus directing the first respondent to consider the request of the petitioner for one time settlement under ‘rinn samadhan 2020-21 (one time settlement of NPA and AUCA) scheme introduced by the first respondent bank b) Pass such other suitable order/s as this Hon’ble Court deems it appropriate in the admitted facts and circumstances of the case in the interest of justice; 2. Learned counsel appearing for the respondent/Bank submits that on 22.10.2008 DRT has passed a decree and the property has been already sold in favour of Respondent No.5. 3. It is submitted by the learned counsel appearing for the petitioner that in the light of the Interim Order dated 14.09.2021 they have paid an amount of Rs.10.00 lakhs to the Bank and requests for refund of the amount. 4. In the light of law laid down by the Apex Court in the case of State Bank of India Vs. Aravindra Electronics Pvt. Ltd.,1 this court cannot grant any directions for one time settlement and there cannot be any direction to the bank to 1 (2023) 1 SCC 540 - 4 - HC-KAR NC: 2026:KHC:20629 WP No. 16677 of 2021 consider the one time settlement. In that view of the matter, this Court is passing the following: ORDER i. Accordingly, the writ petition is dismissed. ii.
