Ms. Manju Dave, Addl. G.A. Mr. Amit Gupta, Addl. G.A Mr. Jaiprakash Tiwari, Dy. G.A. HON'BLE MR. JUSTICE ASHUTOSH KUMAR (VACATION JUDGE) Order 01/06/2026 1. The present bail application has been filed on behalf of the accused-applicant under Section 483 of the B.N.S.S, 2023 against the order dated 03.01.2026 passed by Additional Sessions Judge No. 10, Jaipur Metropolitan-I, Sanganer in connection with FIR No. 794/2024 registered at Police Station Muhana, District Jaipur (South) for the offences punishable under Sections 420, 467, 468, 471 of IPC and Sections 331(4), 324(2),(6), 308(5), 351(3), 303(2) of BNS by which the bail application of the accused-applicant under Section 483 of the B.N.S.S, 2023 has been dismissed. [2026:RJ-JP:22807] (2 of 3) [CRLMB-1683/2026] 2. Learned counsel for the accused-applicant submits that the accused-applicant has falsely been implicated in this matter. Learned counsel argues that allegedly, the accused-applicant tried to sell the plot of the complainant based on the forged Patta. The allegations against the accused-applicant are that he entered into an agreement with one Ranjit Singh to sell the plot for 60 lacs rupees out of which he received 11 lacs rupees in his bank account. Learned counsel argues that there is no documentary evidence against the accused-applicant in regard with 11 lacs rupees being received in his bank account. Learned counsel argues that offences levelled against the accused-applicant are triable by the Magistrate therefore, he should be enlarged on bail. Learned counsel also argues that the accused-applicant was arrested on 17.12.2025 and since then, he is behind the bars. Learned counsel prays that trial will take long time to conclude, therefore, the accused-applicant be enlarged on bail. 3. On the other hand, learned Public Prosecutor opposes the bail application and further contends that two other cases for the offences punishable under Section 376 of IPC and Section 3/4 of POCSO Act have also been found registered against the accused-applicant. 4. Heard learned counsel for the parties and also perused the material available on record. 5. Having regard to the facts and circumstances of the case and considering the facts that the accused-applicant is behind the bars since 17.12.2025; that the charge-sheet has been filed and trial will take long time to conclude, but without expressing any opinion [2026:RJ-JP:22807] (3 of 3) [CRLMB-1683/2026] on the merits/demerits of the case, this Court deems it proper to allow the bail application filed on behalf of the accused-applicant. 6. Consequently, this bail application filed under Section 483 of the B.N.S.S, 2023 is allowed. It is ordered that accused-applicant Kuldeep Singh Chouhan @ Deepu S/o Girraj Singh Chouhan, arrested in FIR No. 794/2024 registered at Police Station Muhana, District Jaipur (South) shall be released on bail; provided he furnishes personal bond in the sum of Rs.1,00,000/- and two solvent attested sureties of Rs.50,000/- each to the satisfaction of the learned trial Court. 7. The Accused-Applicant shall be required to appear before that Court on all dates of hearing and as and when called upon to do so. (ASHUTOSH KUMAR),VJ RACHNA/17
