Learned counsel appearing on behalf of the petitioner submits as follows. The petitioner has been falsely implicated in this case. There was a mere altercation between family members that resulted in registration of the FIR.
Learned counsel appearing on behalf of the State strongly opposes the prayer for anticipatory bail. He relies on the case diary and the memo of evidence and submits that the petitioner was the principal assailant in this case. He relies on the statements of witnesses including the victim and the injury report, which shows cut injury inflicted by a heavy metallic weapon on a vital part of the body like scalp and the wound had to be repaired with stitches. Besides, the petitioner has as many as seven criminal antecedents.
Considering the above and the other incriminating materials
2 available in the case diary, I do not consider this to be a fit case for granting anticipatory bail.
The application for anticipatory bail is, thus, rejected.
Urgent photostat certified copies of this order may be delivered to the learned Advocates for the parties, if applied for, upon compliance of all formalities.
