Heard learned counsel for the parties.

The instant bail application has been preferred by the petitioner for grant of regular bail for the offences registered under Sections 103(1), 3(5) of Bharatiya Nyaya Sanhita (BNS), 2023.

Learned counsel for the petitioner submits that the petitioner has falsely been implicated in this case and he has committed no offence as alleged in the F.I.R. He further submits that the petitioner has got no criminal antecedent and the entire occurrence was unintentional and took place in the spur of the moment as the petitioner along with the deceased and the co-accused were under the influence of country-made liquor. He further submits the petitioner has been languishing in custody since 07.09.2025; as such, the petitioner may be enlarged on bail. He submits that the petitioner is ready to abide by every condition as imposed by this court.

Learned A.P.P. opposes the prayer for bail of the petitioner.

Having regard to the facts of the case and looking to the allegations made against this petitioner coupled with the fact that the petitioner is having no criminal antecedent and the petitioner is in custody since 07.09.2025; therefore, I am inclined to enlarge this petitioner on bail. Accordingly, the petitioner is directed to be released on bail on furnishing bail bond of Rs. 20,000/- (Rupees Twenty Thousand only) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-I, Chakradharpur (Chaibasa), in connection with S.T. Case No. 351/2025 arising out of Bandgaon P.S. Case No. 21/2025.

It is made clear that the petitioner shall appear on each and every date before the learned trial court and he shall not threaten any witnesses and shall co- operate in trial and if any adverse report will come against this petitioner, learned trial court shall be at liberty to cancel the bail of this petitioner.
