The instant application under Order I Rule 10 of the CPC has been preferred by the appellant praying for impleadment of the claimant respondent Nos. 2, 3, 4, 5, and 6 in MAC Case No. 251/2012 as appellant Nos. 2, 3, 4, 5 and 6 in the pending MAC Appeal No. 946/2018 pending before this Court. 2. Heard Mr. S. Ahmed, learned counsel for the applicant and Mr. J. Kalita, learned counsel for the respondent. 3. By filing the instant application, the applicant states that an amended claim petition has been filed before the learned Tribunal wherein the father, brother and sisters of the deceased had been arrayed as opposite party Nos. 4, 5, 6, 7, 8 and 9 respectively. However, due to inadvertence and bonafide mistake the appellant while preferring the connected MAC Appeal did not implead the said claimants Nos.4, 6, 7, 8 and 9 as parties to the appeal. It is stated that the non-impleadment of the said claimants Nos. 4, 6, 7, 8 and 9 is neither deliberate nor intentional but due to oversight. Accordingly, it is prayed that the said claimants may be allowed to be impleaded as appellants in MAC Appeal No. 947 of 2018. 4. In view of the facts and circumstances as stated above, the instant application is allowed. 5. The applicant shall file an amended cause title inserting the names of the claimants Nos. 4, 5, 6, 7, 8 and 9 as appellant Nos. 2, 3, 4, 5 and 6 in the connected MAC Appeal No. 947 of 2018 within a period of one week from today.
