p. 1 IN THE HIGH COURT OF ORISSA AT CUTTACK ABLAPL No.461 of 2026 Sarat Chandra Pradhan @ Sarat Pradhan …. Petitioner Mr. S.K. Pattnaik, Advocate -Versus- State of Odisha …. Opposite Party Ms. B.K. Sahoo, AGA CORAM: MR. JUSTICE R.K. PATTANAIK Order No. ORDER 27.01.2026 01. 1. Heard learned counsel for the respective parties. 2. Instant petition has been filed under Section 482 BNSS by the petitioner seeking pre-arrest bail in connection with K. Nuagaon P.S. Case No.368 of 2024 corresponding to G.R. Case No.561 of 2024 pending in the court of learned J.M.F.C., Digapahandi on the grounds stated. 3. Gone through the contents of the F.I.R. at Annexure-1. 4. A copy of the order in BLAPL No. No.6552 of 2025 is produced in course of hearing to submit that the co-accused, whose name has been mentioned in the FIR at Annexure-1 has been released on bail by the Court’s order dated 16th September, 2025. The further submission is that the victim was rescued on the very same day. In fact, it is claimed that the victim on his own managed to return to the village referring to the order in the BLAPL. Recorded the objection of the State. It does appear that no injury has been caused to the victim. It is also made to appear from Annexure-1 that the victim was p. 2 temporarily detained after being abducted. It is claimed that the alleged incident took place on account of a business rivalry between the parties. The petitioner is alleged to have abducted the son of the informant with the co-accused. Though the name of the petitioner appears in the FIR i.e. Annexure-1 but having regard to release of the co-accused and the fact that the victim escaped unhurt, the Court is of the view that the petitioner though is not entitled to pre-arrest bail but he should be directed to surrender before the learned court below to be released with suitable conditions imposed and accordingly, it is ordered. 5. In the result, the ABLAPL petition stands disposed of with a direction to the petitioner to surrender before learned J.M.F.C., Digapahandi within a fortnight from today and in the event, he surrenders in compliance thereof, shall be released on bail in connection with G.R. Case No.561 of 2024 upon furnishing a bail bond of Rs.30,000/- (rupees thirty thousand) with one solvent surety for the like amount to the satisfaction of the court below, which shall be at liberty to impose such other suitable conditions as deemed just and proper in the facts and circumstances of the case besides the following, such as, he shall cooperate the IO in the investigation and to attend the P.S once in a week for the said purpose without fail. 6. Issue urgent certified copy of this order as per rules. (R.K. Pattanaik) Judge Balara Designation: PERSONAL ASSISTANT
