1. The applicant has preferred this first bail application under Section 483 of Bhartiya Nagrik Suraksha Sanhita Act, 2023 for grant of regular bail as he is arrested in connection with Crime No.237/2025, registered at Police Station – Sakti, District- Sakti (C.G.) for offence punishable under Sections 376(2)(n), 506-B and 201 of IPC and Section 4 & 6 of POCSO Act. 2. As per the prosecution’s case, it is alleged that on 20.04.2024, the applicant entered the house of the minor victim around 12.30 pm and proposed to her. 2 refused, she was forcefully taken to a room and raped as well as threatened to be killed along with her family. Again, in the month of November, 2024, while she was going to college, the applicant forcefully took her on his motorcycle near Ulda Pahad and raped her. Thereafter, on 05.07.2025, at about 12:45 pm, again the applicant entered her house when she was alone and raped her. Based on this, offence has been registered against the present applicant. 3. Learned counsel for the applicant submits that the applicant is innocent and has been falsely implicated in the crime in question. He further submits that the age of the victim as per the record itself was 17 years & 6 months, on the date of the first incident, as alleged by the victim. The victim had become major on the 2nd and 3rd occasions of the alleged incident. The FIR is an afterthought, and the date of the first incident has been so planted by the father of the victim. There is a delay in lodging the FIR as the alleged incident occurred on 20.04.2024 and the FIR was lodged on 12.07.2025. The applicant and the victim were in a love relationship, which was not acceptable to the father of the victim; therefore, he forced the victim to lodge the FIR. The applicant is in jail since 13.07.2025, and the trial is likely to take time to be finalized. Therefore, it is prayed that the applicant may be enlarged on bail. 4.
Per contra, learned Counsel appearing on behalf of the State opposes the bail application and submits that the applicant committed a grievous offence with a minor girl, the victim has supported the case of the prosecution and some important witnesses have yet to be examined; therefore, at this stage, looking to the gravity of the offence, the applicant may not be released on bail. 3
5. The victim and her father appeared through V.C. from the concerned DLSA and raised their objection to grant of bail to the applicant. 6. I have heard learned Counsel appearing for the parties and perused the material available on record. 7. Considering the facts and circumstances of the case, and overall evidence collected by the prosecution against the applicant, and also looking to the gravity of the offence and the statement of the victim, at this stage, without commenting on the merits of the case, I am not inclined to release the applicant on bail. Accordingly, the bail application filed under Section 483 of BNSS, 2023, is rejected. 8. However, considering the fact that the applicant is in jail since 13.07.2025, and out of 19 witnesses, only 5 witnesses have been examined till date, the concerned trial Court is
directed to expedite the trial and to ensure that the trial is concluded as expeditiously as possible, preferably within a period of 5 months from receipt of a copy of this order.
9. Office is directed to sent a certified copy of this order to the trial Court concerned for necessary information and compliance forthwith.
