O R D E R Heard the learned counsel for the petitioner and perused the entire material available on record. With the consent of learned counsel for the petitioner, the present Revision Petition is disposed of, at the stage of admission. 2.
The present Civil Revision Petition is filed aggrieved by the non-disposal of I.A.No.125 of 2025 in G.W.O.P.No.49 of 2024, filed by the petitioner herein, under Section 12 of the Guardian and Wards Act, 1980 (for brevity ‘the Act, 1890’) and Section 151 of the Code of Civil Procedure, 1908 (for brevity ‘CPC’), pending on the file of the learned Principal District and Sessions Judge, West Godavari at Eluru. 3. Parties are referred to, as they are arrayed before the trial Court. 4. Petitioner filed Guardian OP No.49 of 2024 against the respondent, who is none other than his wife, pending on the file of the learned Principal District Judge, West Godavari at Eluru, under Sections 6 to 8, 11, 15 and 17 of the Act, 1890 and Section 151 of CPC, seeking direction to the respondent to deliver custody of the minor child by name Mokshitha Sri to the petitioner. While the said OP is pending, the petitioner filed I.A.No.125 of 2025 under Section

12 of the Act, 1890 and Section 151 of CPC, seeking direction to direct the respondent to send for the ward to the petitioner weekly one day i.e. Saturday or Sunday, for spending with him and further to permit him to contact the ward everyday through video calling after school hours for half an hour. 5.
Learned counsel for the petitioner would contend that I.A.No.125 of 2025 was filed in the year 2025, and pursuant to filing of the said application, the respondent filed counter on 08.05.2025, but the trial Court, without disposing of the said application, has been adjourning the same from time to time. He further contends that if the application is disposed of, expeditiously, there would be possibility of petitioner not meeting his ward.
6. This Court vide Order 17.02.2026 permitted the petitioner to take out personal notice to the respondent by Registered Post with Acknowledgment Due and to file proof of service. Accordingly, the petitioner served notice to the respondent and filed Memo vide USR No.31079/2026, dated 11.03.2026 in the Registry, showing the proof of service to the respondent.
7. A perusal of material on record goes to show that the Guardian OP No.49 of 2024 was filed on 04.11.2024 and the subject application is said to have been filed on 09.01.2025.

According to learned counsel for the petitioner, the respondent filed counter in the said application on 08.05.2025.
8. Be that as it may. The petitioner filed copies of proceedings that were recorded by the trial Court in the Guardian OP No.49 of 2024. A perusal of the proceedings goes to show that undoubtedly, the aforesaid Guardian OP underwent several adjournments between 09.01.2025 and 28.01.2026, but, those adjournments were to the effect that, the trial Court having found that there is an element of settlement between the parties, in order to mediate the issue/dispute between them, twice, the matter was referred to the Permanent Lok Adalat for Public Utility Services concerned, and for once, it was also referred to the Mediation Centre.
9. Today, when the matter has come up before this Court, learned counsel for the petitioner expressed urgency for disposal of, the impugned application pending before the trial Court. Therefore, having regard to the submission made by the
learned counsel for the petitioner, and also having regard to the fact that child custody or guardianship is primarily to protect the welfare of the minor ward, prevent prolonged emotional distress, and resolve restricted interim custody or visitation rights, this Court

is of the opinion that directing the trial Court to dispose of, I.A.No.125 of 2025 in Guardian OP No.49 of 2024 by fixing certain time frame, would meet the ends of justice.

Accordingly, learned Principal District Judge, West Godavari at Eluru is directed to dispose of, I.A.No.125 of 2025 in Guardian OP No.49 of 2024, filed under Section 12 of the Guardian and Wards Act, 1980 and Section 151 of the Code of Civil Procedure, 1908, after hearing both parties in accordance with law, within a period of four (04) weeks from the date of communication of a copy of this Order.
11. With the above direction, Civil Revision Petition No.499 of 2026 is disposed of. There shall be no order as to costs of the Revision Petition. Consequently, miscellaneous applications pending if any, shall also stand closed.
