Goswami, learned Additional Public Prosecutor for the State. Page No.# 2/3 This is an application under Section 483 of BNSS, 2023 with a prayer for granting regular bail. The allegation contained in the FIR is that on 29.04.2026 one Anikeet Chaurasia lodged an FIR before the Officer In Charge of Fatasil Ambari Police Station Kamrup (M) at Guwahati stating inter alia that on 29.04.2026 at around 2 p.m. the vehicle of the informant bearing Registration No AS 25 CC6874 (Mahindra 407 Truck) departed from the go-down of the informant which is situated at Datalpara near PR Height building after loading zarda Pan masala. The above said vehicle was driven by Somen Boro accompanied by two handyman namely Jayanta Bhuyan and Rohit Das and was proceeding towards Lokhra Transport. Thereafter the said vehicle did not reach the said destination even by 4 p.m. After making such inquiry, the informant came to know that the vehicle was found at Amingaon, near Narayana Hospital and after such inspection it was found that the vehicle was completely empty and all the loaded goods were missing. One handyman namely Jayanta Bhuyan was found inside the vehicle in an intoxicated condition. Thereafter the informant brought the vehicle to his go-down at Datalpara. The learned counsel for the petitioner submits that the stolen goods have been recovered and having regard to the period of detention of 39 days, the petitioner may be released on bail. Page No.# 3/3 The learned Additional Public Prosecutor submits with reference to the Case Diary that there is sufficient incriminating material against the petitioner, to whom the goods were subsequently sold and recovered from. The misappropriated articles i.e., 64 bags of pan masala and 16 bags of zarda was sold for Rs. 11,00,000/- after misappropriation by the petitioner.
