For Petitioner(s): Mr.Prakash Adiapadam For Respondent(s): COMMON ORDER These Civil Revision Petitions have been filed seeking to set aside against the common order dated 25-08-2025 in I.A.No.4 & 5 of 2025 in OS.No.38 of 2024 on the file of the Learned Principal District Judge at Puducherry. 2. The respondents filed I.A.No.4 of 2025 in OS.No.38 of 2024 on the file of the Learned Principal District Judge at Puducherry, under Order IX Rule 7 CPC seeking to set aside the exparte order dated 14.11.2024 and also filed IA.No.5 of 2025 in OS.No.38 of 2024 on the file of the Learned Principal District Judge at Puducherry, seeking to set aside the exparte order dated 14.11.2024 in I.A No. 3 of 2024 in OS No. 38 of 2024 and also filed IA.No.4 4 / 7 https://www.mhc.tn.gov.in/judis CRP No. 1332 of 2026 of 2025 in OS.No.38 of 2024 seeking to permit the 1st respondent as power agent of respondents 2 to 12. Upon hearing both sides, the Trial Court allowed the applications. Challenging the same, the petitioner filed this petitions. 3. The learned counsel for the petitioners submits that the respondents have submitted before the Trial Court that they have not appeared due to severe liver related ailment suffered by the first defendant but they have not produced material evidence to that effect, without which the Trial Court allowed the application. Hence, he prays to allow this Civil Revision Petition. 4. Heard the learned counsel for the petitioner. 5. On perusal of records it reveals that the petitioner/plaintiff has filed the suit against 12 respondents/defendants claiming damages for making scandalous allegations. But on the date of hearing, all the respondents were remained exparte but the said exparte order was set aside by the Trial Court. Admittedly, the respondents have stated that all the defendants were unwell so they were not appeared before the Court but to that effect they have not produced any medical records to prove the same. Therefore, the objection raised by the learned counsel for the petitioner is justifiable. However, it is the suit for claiming damages and the fair opportunities to be given to the respondents to submit 5 / 7 https://www.mhc.tn.gov.in/judis CRP No. 1332 of 2026 their defence otherwise their valuable right will be defeated. However the Trial Court made observation that for 7 hearings they were remain absent. Taking note of the same, the defendants/respondents are instructed to cooperate for the trial proceedings. Further, the Trial Court is directed to complete the Trial within a period of 6 months from the date of receipt of a copy of this order. 6. This civil revision petition is disposed of accordingly.
