JUSTICE SACHIN SHANKAR MAGADUM - 3 - HC-KAR NC: 2026:KHC:14604 WP No. 30169 of 2025 ORAL ORDER The captioned petition is filed seeking the following reliefs: "a) Pleased to issue Writ of Mandamus to 2nd Respondent Authority - the Chariman, RERA, Bengaluru to wave of penalty/delay fee of Rs.23,00,000/- imposed to the petitioner/his project 'Hasija Enclave' formed in Sy.No.142/1 & 142/2, Thornahalli Village, Kasaba Hobli, Malur Taluk, Kolar District vide Annexure-D. b) Pleased to issue Writ of Mandamus or necessary direction/s to consider the representation dated 13.08.2025 given by the petitioner to the 2nd respondent vide Annexure-E, in accordance with law. c) Pleased to pass any order or directions as this Hon'ble Court as feels deem fit under the circumstances of the case in the interest of justice and equity." 2. The petitioner, a land developer, is aggrieved by the levy of penalty/delay fee amounting to - 4 - HC-KAR NC: 2026:KHC:14604 WP No. 30169 of 2025 Rs.23,00,000/- imposed in respect of the ongoing project undertaken by the petitioner. 3. Today, learned counsel appearing for respondent No.2/authority has placed on record a Circular. Referring to the said Circular, he submits that the authority has granted one final opportunity to the petitioner and similarly placed promoters to submit the requisite quarterly updates on or before 31.03.2026. 4. Learned counsel appearing for the petitioner submits that the petitioner is willing to comply with the said requirement and shall submit the quarterly updates on or before 31.03.2026 in terms of the Circular. 5. Recording the submission made on behalf of the petitioner and taking note of the Circular dated 07.02.2026, whereby time has been extended to promoters/developers to submit quarterly updates till 31.03.2026, this Court deems it appropriate to dispose of the petition, reserving liberty to the petitioner to comply - 5 - HC-KAR NC: 2026:KHC:14604 WP No. 30169 of 2025 with the requirements in terms of the said Circular within the stipulated time.
