JUSTICE SUDESH BANSAL Order 21/05/2026 1. This writ petition is an offshoot of scrapping the Direct Recruitment of Sub-Inspector/ Platoon Commander- 2021. 2. Petitioners have pleaded and come up with a case that they were regularly appointed to the post of Patwari vide appointment order dated 08.07.2022, issued pursuant to Patwari Recruitment– 2021. After joining the post of Patwari, and with the permission of the Department, they participated in the Direct Recruitment process for the post of Sub-Inspector/ Platoon Commander–2021. [2026:RJ-JP:21462] (2 of 4) [CW-7202/2026] It has further been pleaded that both petitioners were finally selected for the post of Sub-Inspector and were offered appointment vide order dated 21.09.2023. Thereafter, in order to join the post of Sub-Inspector, petitioners tendered their resignations from the post of Patwari, which were duly accepted, and both petitioners joined the post of Sub-Inspector w.e.f. 09.10.2023. 3. It has further, inter alia, been pleaded that the Direct Recruitment for the post of Sub-Inspector/ Platoon Commander– 2021 came to be challenged on account of the paper leak, and ultimately, the entire recruitment process has been scrapped. In this regard, it has been pointed out that a Coordinate Bench of this High Court, in S.B. Civil Writ Petition No.13806/2024, vide judgment dated 28.08.2025, invalidated the entire process of Direct Recruitment for Sub-Inspector/Platoon Commander–2021 and in Para No.134(vi) of the said judgment, following directions were issued:- “(vi) That in case of termination of the candidate appointed, if any one of them have resigned their Government services to join the new post, order should be issued for their reinstatement to their original posts in Government Service, in above terms.” 4. It has further been pointed out that the judgment and directions dated 28.08.2025 passed by the learned Single Judge, have been affirmed by the Division Bench, vide judgment dated 04.04.2026 passed in D.B. Special Appeal Writ No. 1364/2025. It has also been submitted that the Special Leave Petitions preferred thereagainst, came to be dismissed by the Hon’ble Supreme Court vide order dated 04.05.2026. Hon’ble Supreme Court, while [2026:RJ-JP:21462] (3 of 4) [CW-7202/2026] dismissing the SLPs, has also made it clear that “it is, however, clarified that those petitioners who resigned from services either under the Central Government or Public Sector Undertakings to accept appointments in furtherance of the selection process, since invalidated by the High Court, shall be at liberty to approach the High Court with an application for review seeking similar relief that might have been granted to those petitioners who resigned from services under the State to join the posts.” 5. Hence, in furtherance of the directions issued by the Coordinate Bench of this Court in Para No.134(vi) of the judgment dated 28.08.2025 (supra) and in view of the liberty granted by the Hon’ble Supreme Court in the order dated 04.05.2026 (supra), in the instant writ petition, petitioners seek directions against respondents to permit them to rejoin/ reinstate on the post of Patwari with all consequential benefits. 6. Petitioners have further pleaded that they have already submitted separate written representations dated 07.04.2026 (Annexure-7) before the concerned authority, i.e., the District Collector, Ajmer, seeking their reinstatement to the post of Patwari, however, the same have not been considered by the respondents till date. 7. On behalf of respondents, Additional Government Counsel has put in appearance and states that the representations dated 07.04.2026 submitted by petitioners shall be considered and decided in accordance with law, keeping in view the directions issued by this High Court as well as the Hon’ble Supreme Court. In view of the above, and before entertaining the present writ petition, this Court deems it just and proper to grant an opportunity to respondents to examine the issue regarding reinstatement of petitioners to the post of Patwari along with consequential benefits. Accordingly, the District Collector, Ajmer is directed to decide the representations dated 07.04.2026 (Annexure-7) filed by petitioners, expeditiously and preferably within a period of three months from today. 9. This Court expects that the District Collector, Ajmer shall consider the entirety of facts and circumstances of the case and take a conscious decision to deal with the grievances of petitioners by passing a reasoned and speaking order. 10. With the aforesaid direction/ observations, instant writ petition stands disposed of. 11. Stay application and pending application(s), if any, also stand disposed of.
