[2026:RJ-JP:21544] HIGH COURT OF JUDICATURE FOR RAJASTHAN BENCH AT JAIPUR S.B. Criminal Miscellaneous Bail Application No. 13979/2025 Aditya S/o Mahendra Singh, Aged About 19 Years, R/o Dhingadiya Tehsil Surajgarh, District Jhunjhunu. ----Petitioner Versus State Of Rajasthan, Through The P.P. ----Respondent For Petitioner(s) : Mr. Himang Singh Sinsinwar for Mr. Harendra Singh For Respondent(s) : Mr. Vijay Singh Yadav, PP HON'BLE MR. JUSTICE RAVI CHIRANIA Order 21/05/2026 1. The petitioner has moved this instant bail application under Section 482 of B.N.S.S, 2023 apprehending arrest in connection with the FIR No.227/2025 dated 28.07.2025, registered at Police Station Chirawa, District Jhunjhunu for the offences punishable under Sections 8 and 20 of Narcotic Drugs and Psychotropic Substances Act, 1985. 2. Learned counsel for the petitioner submits that the petitioner is a student of B.Sc.-II year, studying in a college of University of Delhi. On the date of incident i.e. 27.07.2025, he took a vehicle (Bolero) on rent from a company to go on a religious trip along- with his grandfather and thereafter, when he came back, some of his friends took the vehicle and later on it came out that they were allegedly carrying some alleged contraband substance in the vehicle. Learned counsel submits that the petitioner was not [2026:RJ-JP:21544] (2 of 3) [CRLMB-13979/2025] aware of the fact that his friends were carrying contraband substance in the vehicle. In view thereof, learned counsel prayed that the petitioner may be granted the benefit of bail under Section 482 BNSS. 3. Learned Public Prosecutor strongly opposes the bail application by submitting that the vehicle bearing No. HR48 E 5761 was taken on rent by the petitioner herein, who has presented himself as a student of B.Sc. II year, and the contraband substance (ganja) recovered from the vehicle is quantified as 46Kgs 900 grams, which is more than the commercial quantity, i.e. 20 Kgs, under the NDPS Act. 4. Learned Public Prosecutor further submitted that the co- accused person, namely Pankaj @ Papda S/o Subesingh, who is also a student of B.Sc. has narrated the entire incident in his enquiry note, in which he has specifically stated that both, he and the petitioner, were involved in transporting the alleged contraband substance for sale, which was recovered from the vehicle taken on rent by the petitioner herein. In view thereof, he submits that the present case is not a fit case for granting benefit under Section 482 of BNSS, 2023 and the bail application deserves to be dismissed. 5. Heard learned counsel for the parties. 6. This Court considered the fact that the petitioner is a student of B.Sc. second year and as per the investigation carried out till now, he appears to be involved in the sale and purchase of contraband substance for easy money. The alleged contraband substance as recovered, which is more than the commercial quantity, was found in a vehicle which the petitioner took on rent [2026:RJ-JP:21544] (3 of 3) [CRLMB-13979/2025] from a company. As far as the conduct of the petitioner is concerned, the co-accused person Pankaj has also disclosed the complete incident indicating the involvement of the petitioner in the entire case. 7. Nowadays, students are entering into illegal acts of sale and purchase of contraband substances because of greed for easy money. Such kind of practices are growing in big numbers across the nation and spoiling the society, leaving a deep mark on adolescents and even younger generation. 8. In view of the above facts and after noticing the role of the petitioner from the case-diary, this Court is not inclined to exercise its power under Section 482 BNSS, 2023. 9. Accordingly, the instant bail application is dismissed. (RAVI CHIRANIA),J 26/Dushyant
